These terms are an agreement between you and Wilson Redd, who publishes Caravan as Code Redd ("we" or "us"). You accept them when you create an account by tapping Send code, or when you otherwise use Caravan. If you don't agree, please don't use Caravan. They sit alongside our Privacy Policy, which explains what we collect and who can see it.
Arrival times, distances and positions come from phones' GPS, from Google Maps, and sometimes from Caravan's own rougher estimates. They can be wrong, late or missing: GPS drifts, connections drop, and traffic changes. To keep Caravan free, it has a budget for map services. When the budget runs low, Caravan switches to less precise arrival times (the app tells you when), and destination search may pause until the budget resets. Don't rely on Caravan where being wrong could cause harm.
Don't misuse Caravan. That includes harassing other people, using it for anything unlawful, trying to get into accounts or caravans that aren't yours, interfering with the service, or using automated tools, scrapers or modified apps to access it.
You're responsible for the names, nicknames and trip names you add. They must not be offensive or impersonate anyone, and we may remove them.
Caravan includes Google Maps features and content. Your use of them is subject to the current versions of the Google Maps End User Additional Terms of Service at https://maps.google.com/help/terms_maps/ and the Google Privacy Policy at https://policies.google.com/privacy. If you break those terms, we may suspend or end your use of Caravan.
Caravan's app, name and design belong to us. We give you a personal, non-transferable license to use the app under these terms. Don't copy, modify or reverse engineer it except where the law allows. We may change or stop any part of Caravan at any time.
No warranty. Caravan is free and provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free service. We don't promise that arrival times, locations or anything else in Caravan will be correct, current or available.
Limits on our liability. To the fullest extent the law allows: (1) we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or missed or late arrivals; and (2) our total liability for all claims about Caravan or these terms is limited to the greater of US$50 or what you paid us for Caravan in the 12 months before the claim. These limits apply whatever the legal theory, even if we were told the damage was possible. They don't limit liability for our gross negligence, willful misconduct or fraud, for death or personal injury where the law doesn't allow it to be limited, or anything else the law doesn't allow us to limit. Some places don't allow some of these limits, so they may not all apply to you.
If you got Caravan from Apple's App Store, Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. If it conflicts with these terms, these terms apply as far as the law and Apple's rules allow. These terms are between you and us, not Apple or Google. Apple and Google (including Google Play) aren't responsible for Caravan, its content, support or any claim about it, and Apple and its subsidiaries may enforce these terms as third-party beneficiaries.
You can stop using Caravan and delete your account at any time. We may suspend or end your access if you break these terms or Google's terms, if the law requires it, or to protect people or the service. The sections on estimates, warranties, liability and law still apply after your account ends.
We may update these terms. If a change is significant, we'll tell you in the app before it takes effect and ask you to accept it before you keep using Caravan. Changes never apply to a dispute that started before them. If you don't agree, you can stop using Caravan and delete your account at any time.
Washington State law governs these terms and any dispute about Caravan, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts located in Washington, and you and we agree to those courts' jurisdiction. Either of us may bring a qualifying claim in small claims court instead. If you live outside Washington, this doesn't remove any right your local consumer law gives you.
If a court finds part of these terms unenforceable, the rest still applies, and that part is enforced as far as the law allows. These terms and the Privacy Policy are the whole agreement between us about Caravan. If we don't enforce a term right away, we can still enforce it later. We may transfer these terms to a company that takes over Caravan, such as Code Redd LLC. You can't transfer your account or these terms.
